Copyright protection: the prerogatives conferred

Copyright confers two types of prerogative on the creator of a work:

  • Economic rights linked to the work, which enable the author to decide on the conditions of its exploitation, and to receive remuneration in return. In France, these rights are valid for 70 years after the author’s death.
  • A moral right linked to the author’s personality, giving him the right to oppose disclosure of his work without his consent, to request its withdrawal, to claim authorship, and more generally the right to respect for his work.

Copyright protection

Copyright protection in France is automatic from the moment of creation, but is not sufficient in the event of litigation.

French copyright protects original works of the mind from the moment they are created. No formal deposit or material fixation of the work is required. Your creation is therefore protected from the day it is created, whatever its form of expression, its genre, the merit of its author or its destination.

Although no registration formalities are required to obtain copyright protection, in the event of a dispute you must be able to provide proof of the date on which you created your work. That’s why it’s a good idea to register your creation.

Limits to copyright

Copyright protection alone is not effective in the event of a dispute, as it does not provide proof of the work’s anteriority. This is why it is preferable to combine it with other forms of protection, such as design rights, trademarks or copyright.
