In France, all original creations are protected by copyright. The laws of March 11, 1957 and July 3, 1985 stipulate that the creator has exclusive ownership of the work, the sole right to use it, and the right to authorize or refuse its use by a third party.

Articles L.111-1 and L.123-1 of the French Intellectual Property Code stipulate that authors enjoy their music copyright for life. On his death, this right passes to his heirs for a period of 70 years. Music protection is therefore granted as soon as the work is created, but in the event of plagiarism, it is better to have demonstrated ownership of the production by more reliable means.

As explained above, music rights are de facto obtained through music copyright. In order to protect their creations reliably, however, authors are well advised to file a music copyright application with organizations, public officials or companies specializing in music copyright protection.

The authenticity and ownership of a musical work can be protected by SACEM (Société des Auteurs, Compositeurs et Editeurs de Musique), provided at least 5 works have been registered, including one already in use. The SNAC (Syndicat National des Auteurs et Compositeurs) and the INPI (Institut National de la Protection Intellectuelle) also provide music protection, as do bailiffs and notaries. These procedures have a cost for the author, and the protection of musical rights is more or less long and extensive depending on the intermediary chosen.

It should be noted, however, that SACEM is responsible for the authorship of works and the management of royalty payments (the famous “droits d’auteur”).
