In France, all original creative work is protected by copyright. The Acts of 11 March 1957 and 3 July 1985 mention the right of exclusive ownership of a work by its creator, the right on exploitation and the right to authorize or refuse use by a third party.
Articles L.111-1 and L.123-1 of the Intellectual Property Code specify that the author shall enjoy the music copyright during their lifetime. Upon their death, this right is transferred to their heirs for a period of 70 years thereafter. As explained above, musical copyright is automatically conferred. Nevertheless, to reliably protect their creative work, authors should register their music or copyright with an organization, a governmental agency or companies specialized in the protection of music copyright.
The authenticity and ownership of a musical work can be protected by SACEM (Society of Authors, Composers and Music Publishers) provided that at least 5 works are filed with them, including one already being reproduced. The SNAC (National Union of Authors and Composers) and the INPI (National Institute of Intellectual Protection) also provide music protection, as do lawyers and attorneys. This procedure does have a cost for the author and can be a long and drawn-out process depending on the intermediary chosen.
